These Terms of Service ("Terms") are a binding agreement between you and 18032912 Canada Inc., doing business as Pako ("Pako", "we", "us", or "our"), a corporation incorporated federally in Canada and registered in the Province of Quebec. By downloading, installing, or using the Pako mobile application or visiting meetpako.com (together, the "Services"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by other reasonable means. Your continued use of the Services after an update means you accept the revised Terms.
You must be at least 13 years old to use Pako. By using the Services, you represent that you are 13 or older and able to form a binding contract. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian. We may terminate any account we reasonably believe is held by someone under 13.
Pako is a pet health and longevity tracking application that helps dog owners log daily care and generates estimates and insights such as a Health Score, Lifespan Projection, and nutrition and activity targets to support better care decisions.
Pako is not a veterinary service and does not provide veterinary or medical advice. All content, scores, projections, and insights are for general informational and educational purposes only and are not a diagnosis, treatment, or a substitute for professional judgment. Always consult a licensed veterinarian about your dog's health, and never delay or disregard professional advice because of something you read in Pako. In an emergency, contact a veterinarian immediately.
Some features use artificial intelligence to produce results — for example breed identification, food and health scans, and the in-app assistant. AI outputs are generated automatically and may be inaccurate, incomplete, or not applicable to your dog. They are estimates, not facts, and are not professional advice. You are responsible for how you use AI results, and you should verify important decisions with a licensed veterinarian. We do not guarantee the accuracy, reliability, or availability of any AI feature.
To use certain features you must create an account. You agree to provide accurate information, keep it up to date, keep your credentials confidential, notify us promptly of any unauthorized use, and accept responsibility for activity under your account.
You agree to use the Services only for lawful purposes and not to:
Pako offers a free tier and a paid subscription ("Pako Premium"), currently available as a weekly plan and a yearly plan. The exact price, billing period, and any free-trial length are shown to you in the app at the point of purchase before you confirm.
Subscriptions are sold and billed through the Apple App Store (and, in the future, Google Play). Payment is charged to your platform account when you confirm the purchase. We do not receive or store your payment card details.
If your plan includes a free trial, your subscription automatically converts to a paid subscription and you will be charged when the trial ends, unless you cancel at least 24 hours before the trial period ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
Your subscription automatically renews for the same period at the then-current price, and your payment method is charged, unless you cancel at least 24 hours before the end of the current period. Renewal continues until you cancel.
You can cancel anytime by managing your subscription in your device settings: on iOS, open Settings → your name → Subscriptions, select Pako, and cancel. Cancellation takes effect at the end of the current billing period, and you keep access until then. Deleting the app does not cancel your subscription.
Because billing is handled by the app store, refunds are governed by the applicable store's policies, and we generally cannot issue refunds directly. To request a refund, contact Apple through your App Store account. If we change subscription prices, we will give you advance notice, and price changes apply only to future billing periods. Nothing in this section limits any non-waivable rights you have under consumer protection law, including Quebec's Consumer Protection Act.
You keep ownership of the content you submit to Pako, including dog profiles, health logs, photos, and messages ("User Content"). You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display your User Content solely to operate, provide, secure, and improve the Services. You represent that you have the rights to submit your User Content and that it does not infringe any third-party rights or violate any law.
The Pako app, website, name, logo, and all related content and functionality are owned by 18032912 Canada Inc. and protected by intellectual property laws. Except for your own User Content, you may not copy, modify, distribute, sell, or create derivative works from the Services without our prior written permission.
The Services rely on and may link to third-party services (such as our hosting, AI, subscription, and data providers). We are not responsible for third-party services or their content, and your use of them may be governed by their own terms and privacy policies.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY SCORE, PROJECTION, OR AI OUTPUT IS ACCURATE OR COMPLETE. PAKO IS NOT A VETERINARY SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAKO AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR FOR HARM TO YOUR DOG'S HEALTH, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) CAD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU, AND NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
You agree to indemnify and hold Pako harmless from claims, damages, losses, and reasonable expenses (including legal fees) arising from your misuse of the Services, your User Content, or your violation of these Terms or of any law or third-party right.
We may suspend or terminate your access to the Services at our discretion if you violate these Terms or if we reasonably believe your use is harmful to other users, to us, or to third parties. You may stop using the Services and delete your account at any time in the app settings. Sections that by their nature should survive termination will survive.
The following applies when you download Pako from the Apple App Store:
Please read this section carefully. It affects how disputes are resolved and, for U.S. residents, limits class actions and requires individual arbitration.
Most concerns can be resolved quickly. Before starting any formal proceeding, you agree to first contact us at support@meetpako.com with a short description of the issue and your contact information, and to give us at least 30 days to resolve it. We will do the same before bringing any claim against you.
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
Except where the arbitration terms below apply, and subject to any non-waivable rights you have as a consumer, any dispute arising from these Terms or the Services will be resolved exclusively by the courts located in the Province of Quebec, and you and Pako submit to their jurisdiction.
If you are a resident of the United States, you and Pako agree that any dispute that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for intellectual-property or unauthorized-access matters. You and Pako agree to bring claims only in an individual capacity, and each waives the right to participate in any class, collective, consolidated, or representative action. For any claim seeking less than US$10,000, Pako will reimburse your arbitration filing fees, unless the arbitrator determines the claim is frivolous.
30-day opt-out: You may opt out of this arbitration and class-action-waiver agreement by emailing support@meetpako.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out will not affect any other part of these Terms.
This arbitration section does not apply to the extent it is prohibited or unenforceable under the law that applies to you — including for consumers in Quebec and elsewhere in Canada, whose rights to bring a claim in court and to participate in class actions are preserved.
